MARKET PRACTICES & INTELLECTUAL PROPERTY LAW (IP)

We regularly advise our clients on matters contained in Book VI of the Code of Economic Law (“WER”), concerning market practices, such as comparative advertising, sales [ at reduced price] and the periods in which such sales activities are not permitted, misleading advertising, unfair market practices and third party complicity in breach of contract.

We have considerable experience with respect to prohibitory injunctions.

With regard to intellectual property rights, we carry put the necessary activities for our clients concerning advising about and filing trade marks (both in Benelux and in the EU) & models. With regard to the filing of patents, we often work together with specialised patent agents, in view of the technical nature of patents. With respect to the filing of trade marks and models, and any market research, we refer you to our separate brochure, which you can find here.

We advise on a regular basis concerning the validity and enforceability of national and international trade marks, models (whether registered or not), patents, know-how and copyright. The drafting of contracts on these matters, such as licence agreements also forms part of our practice.
